Arrested after two stand-offs with police
A 51-year-old man who admitted “willful cruelty” to his own father, and assaulting two police officers, was sentenced to more than 24 years in prison, last month.
Noel Sean Myers pleaded guilty to one felony count of “willful cruelty to elder” and two felony counts of assault with a deadly weapon on a peace officer, in a plea deal. Four other felony charges were dropped in the deal.
Oceanside police said they were first called to Myers’ home on South Cleveland Street on May 8, 2012. On that day, police reportedly rescued Myer’s father, who had been “assaulted” and “dragged outside” by his son; the 81-year-old man suffered a “fractured right femur,” and was admitted to Tri-City Hospital, according to a detective’s report.
“OPD officers attempted to arrest Noel Myers,” but the man retreated back into his residence and “he began to throw rocks, bottles, bricks, a television and a VCR,” according to a detective’s report. A machete and a glass bottle and a tire iron were also thrown at police, according to the report. “Noel Myers then armed himself with a rifle which forced officers to withdraw,” the report stated.
Police were able to get an arrest warrant signed on May 10 and they went back to Myers’ home. When police arrived about 3 p.m. that day, their suspect was allegedly assaulting a neighbor with a pipe.
“Myers barricaded himself in the residence when officers arrived,” according to a press release issued by police, later that day. “Myers shot projectiles from an air rifle at police during the stand-off, striking a police sergeant in the face and an officer on his helmet.” The suspect went in and out of his house, and threw Molotov cocktail which did not ignite, and “verbalized to officers that he was not going to surrender,” police stated. After about three hours, the SWAT team used tear gas and “Myers subsequently exited the home and surrendered without further incident.”
In the plea deal paperwork, Myers admitted a strike prior, a robbery, in the San Francisco area from 1996, when he was 34-years-old.
