Cheap For San Diego Utility Ratepayers At Only $29 Million?

A followup report adds some more information to the previous blog post on the Z-Factor Back Story, where KUSI's Turko Files is apparently the only other media outlet to report on the motion to remove Commissioner Timothy Simon for his ex parte hearing of SDG&E testimony and evidence "in secret and we believe in violation of the rules" as alleged by Michael Aguirre, former San Diego City Attorney and representative of SDG&E Z-Factor application A0908019 protester Ruth Henricks.

Administrative Law Judge Maribeth Bushey did not hear the additional SDG&E testimony and evidence, and ruled against SDG&E's A0908019 application based on the evidence submitted before final statements were made by all parties in an open hearing. SDG&E's private ex parte meeting with Simon was done without rebuttal by any other parties, and Simon subsequently ruled in favor of SDG&E. According to Aguirre, Simon's contrary opinion "might as well have been written by SDG&E. It's a travesty..."

As part of Simon's contrary opinion, San Diego power consumers may be on the hook for nearly $29 million in SDG&E damages caused by SDG&E 2007 overhead equipment failures and explosions that resulted several county wildfires and the largest mass evacuation in county history. The opposing proposed decisions by Bushey and Simon will be reconciled by California's Public Utilities Commission at a date to be set later.
